@imsou can I ask what's "four times"
Posted byAsgASGabout 4 years
Hi Lucky, Congrats on your Citizenship application progress and appointment letter- I think they asked for police clearance not because you spent 90 days in India before entry to Australia because your four times' count starts the moment you enter Australia (if you were granted the visa offshore), and once it is granted if you are onshore at the time of grant. So the reason they asked for the Police clearance is because India is your home country (they also asked for mine) regardless of how long you spent there before you entered Australia.

@Lucky - For Penal Clearance Certificates - dont you need to satisfy all 3/4 conditions together as it is "and" condition:

"The following requirements apply to the period of time you have held a permanent Australian visa. You need an overseas penal clearance certificate if:

you lived or travelled overseas since the age of 18 years, and
the total time you spent overseas adds up to 12 months or more, and
the total time you spent in one country adds up to 90 days or more.
If this applies to you, provide an overseas penal clearance certificate from each country where you spent a total of 90 days or more in.

But ofcourse Dept may ask independent which is separate.

@Bondi Girl, I got offshore permanent resident visa. So they consider the PR from the date they have granted visa. I thought they start the residency calculator from the day when we enter into Australia. I got visa in July 2016 and came to Australia in OCT 2016 so it was more than 90 days. After coming to Australia, I was never away for 90 days so I was under impression I don't need Police check from INDIA. Anyhow , Applied the Police check , will get in few day. Did you get yours ?

Hi Lucky, can I ask why you didn't have one prepared? Did yours expire or had you paid for one through a third party that wasn't accepted?

Yes Ryan, I migrated under skill migration and my first entry was after 90 days from the grant date. I was under impression that they start considering the 90 days check after first entry. but they start this check on the grant date.

Hi Lucky

Is it because you spent time in India for more than 90 days after PR, that they requested for Police clearance?

Thanks
